The short version
- Our App Store games don't require an account (except Jailbreak, below), and we don't collect your name, email address, or contacts through them. Their progress is stored on your device.
- Jailbreak, our online game for the web browser, iPhone, and iPad, uses an account with a game name and password (no email), or a guest prisoner on CrazyGames. It keeps your progress on our game server, asks for your birth month and year for chat (13 and over), and has chat with other players.
- Some games show ads. Our advertising partner may process device information to show and measure those ads.
- If you email us, we use your message only to help you.
- We never sell your personal information.
This policy covers the games and apps published by Tomato Factory on the App Store, our browser games such as Jailbreak (together, our "apps"), this website, and our support channels. The details are below.
Who we are
Tomato Factory, LLC ("Tomato Factory", "we", "us") is an independent game studio based in Abilene, Texas. For anything related to privacy, contact us at [email protected].
Information we collect
Information you give us
When you email us or use the support form, we receive your email address, your name if you include it, and whatever you write, such as your device model and a description of a problem. Messages sent through the support form are delivered to our inbox by our email provider, Mailgun. To block spam, our server briefly keeps the IP address a form message came from.
Information stored on your device
Game progress, high scores, settings, and unlocked items are saved locally on your device. We don't have access to this data. If a game uses Game Center or iCloud, that data is handled by Apple under Apple's Privacy Policy.
Jailbreak (online game)
Jailbreak is played online at jailbreak.tomatofactory.com, on CrazyGames, and in the Jailbreak app for iPhone and iPad. On our site and in the app, you create an account (one account works in both). On CrazyGames, you start straight away as a guest with a made-up name (such as Inmate12345), and you can add a password later to keep your prisoner. We keep:
- Your game name and, if you have one, your password, stored scrambled (hashed) so nobody can read it, including us
- The month and year you were born, only to check that you're 13 or older before chat turns on (we don't ask for the day)
- Your character's look and game progress, such as items, tokens, team, and gang
- Moderation records, such as mutes and bans, and a log of actions our staff take
We don't ask for your email address, real name, or location. Guests don't have chat. Chat messages are passed to other players as you send them and shown in the game. So our staff can check reports, our server keeps the most recent chat messages (the latest 1,000 across the whole game; older ones are dropped as new ones arrive) and the messages attached to each report (the latest 500 reports). A filter blocks offensive words, and staff can mute or ban players. While you're connected, our server briefly uses your IP address to stop password guessing and mass sign-ups; it isn't stored with your account. Your browser (or the app) keeps a sign-in token, your character's look, and settings in its local storage, so you stay signed in (for a guest, that token is how the game finds your prisoner again).
In the iPhone and iPad app, the game files are inside the app, and it talks to the same game server as the website. The app shows ads from Google AdMob only at natural breaks (at most one every 3 minutes), as described below, and your escapes go to Apple's Game Center leaderboard if you're signed in to Game Center. You can delete your account in the game: open the pause menu and tap Delete My Account.
On CrazyGames, the game runs inside the CrazyGames website, and their privacy policy covers what their site collects. We don't receive your CrazyGames account details; we only tell CrazyGames which of our servers you're playing on, so your friends can join you.
The "Host Game" and "Join with Code" modes connect players' browsers directly to each other (using PeerJS), which shares your IP address with the other players in that game.
Voleur: Rooftops of Paris
Voleur has no accounts and doesn't ask for any personal information. Your progress (louis, outfits, goals, best scores and how many days in a row you've played) is saved on your device. On CrazyGames, if you're signed in to CrazyGames, your progress is also kept with your CrazyGames account through CrazyGames' save system, so it follows you to other devices; their privacy policy covers that, and any ads in that version are shown by CrazyGames. In the iPhone and iPad app, your scores go to Apple's Game Center leaderboards if you're signed in to Game Center, and the app shows ads from Google AdMob between runs, as described below.
Information collected by advertising partners
Several of our games and apps show ads, and some let you watch a short video ad to unlock an item. To deliver ads, measure how they perform, and prevent fraud, our advertising partner may collect information from your device, such as:
- Device type, operating system version, and language
- IP address and approximate location derived from it
- Ad interactions, such as whether an ad was shown or tapped
- Your device's advertising identifier, only if you allow tracking (see "Your choices" below)
Our current advertising partner is listed in the third-party services section.
Purchases
If an app offers in-app purchases, Apple processes the payment. We don't receive your payment card details or billing address.
This website
This website doesn't use cookies or tracking. We count visits with Cloudflare Web Analytics, which doesn't use cookies or identify you; it tells us which pages are read and where visitors came from. Cloudflare and our web host may keep standard server logs, including IP addresses, for security and to keep the site running. The site loads fonts from Google Fonts, which receives your IP address when it delivers them.
How we use information
- To answer your questions and fix problems you report
- To keep our apps working, secure, and free of fraud
- To show ads that help keep our games free
- To meet our legal obligations
We don't use your information to build profiles about you, and we don't make automated decisions that have legal or similarly significant effects on you.

These companies may process information when you use our apps. Each is responsible for its own practices, described in its privacy policy.

How we share information
We don't sell your personal information, and we don't share it for cross-context behavioral advertising except through the advertising partners above, and only when you allow tracking. We share information only:
- With the service providers listed above, to run our apps
- When the law requires it, or to protect the rights and safety of our players and others
- If Tomato Factory is involved in a merger or acquisition, in which case this policy continues to apply to your information
Children's privacy
Our App Store games are rated 4+ and may be enjoyed by players of all ages. We don't knowingly collect personal information from children under 13 (or the equivalent minimum age where you live).
Jailbreak has online chat with other players and is meant for players 13 and older; it isn't directed to children. If we learn that a child under 13 has made a Jailbreak account, we'll delete it.
Our apps don't ask for names, email addresses, photos, or location. Ads shown in our apps are intended to be suitable for general audiences. We don't ask children for permission to track, and we don't want advertising partners to use children's data for personalized advertising.
If you're a parent or guardian and believe your child has sent us personal information, for example in a support email, contact us at [email protected] and we'll delete it.
Your choices
Ad tracking
On iPhone and iPad, apps must ask your permission before tracking you across other companies' apps and websites. If you choose "Ask App Not to Track", your advertising identifier isn't shared and you'll only see non-personalized ads. You can change this any time in Settings > Privacy & Security > Tracking.
You can also turn off personalized ads from Apple in Settings > Privacy & Security > Apple Advertising.
Deleting your data
Our App Store games don't have accounts, so there's nothing to sign out of or close; deleting an app from your device removes the progress and settings it stored there. To delete a Jailbreak account and everything saved with it, use Delete My Account in the game's pause menu, which deletes it straight away, or email us with your game name and we'll delete it within 30 days. To delete support emails you've sent us, see the next section.
Your privacy rights
Depending on where you live, including the European Union, the United Kingdom, California, and other US states, you may have the right to:
- Know what personal information we hold about you and get a copy
- Correct information that's wrong
- Delete your information
- Object to or restrict certain uses, and opt out of targeted advertising
- Withdraw consent where we rely on it
- Complain to your local data protection authority
To make a request, email [email protected] with the subject "Privacy request". We'll respond within 30 days and won't treat you differently for exercising your rights. Since we hold very little about you, the easiest way to help us find it is to send the request from the email address you contacted us with.
Where the GDPR applies, we process information to provide the service you asked for (answering support requests), for our legitimate interests (keeping apps secure and funding them with ads), and with your consent (tracking, via Apple's permission prompt).
How long we keep information
We keep support emails as long as we need them to help you, and delete them within two years of our last reply unless the law requires us to keep them longer. Data on your device stays until you delete the app. Jailbreak accounts and progress are kept until you ask us to delete them; staff action logs keep their latest 500 entries. Advertising partners keep data according to their own policies.
Security and international transfers
We use reasonable measures to protect the information we hold, including limiting who can access our support inbox. No method of storage or transmission is completely secure.
We're based in the United States, and our service providers may process information in other countries. Where required, transfers are protected by safeguards such as the European Commission's Standard Contractual Clauses.
Changes to this policy
If we change this policy, we'll update the date at the top of this page. If the changes are significant, we'll also note them on our News page.
